Insurance Policy

2026-10-06 01:50:01

An insurance policy (commonly referred to as a policy) is a legal instrument issued by an insurer to a policyholder that certifies the formal execution and validity of an insurance contract. In the motor vehicle insurance sector, the policy serves as the core document establishing the legal relationship and setting out the rights and obligations of both parties, while also providing the statutory basis for the insured to make claims and obtain financial compensation in the event of an insured incident.

Legal Nature and Core Functions of an Insurance Policy

As the written embodiment of an insurance contract, a policy plays an indispensable role in commercial transactions and legal proceedings:

Proof of Contract Formation and Validity:

The policy is the final legal instrument issued by the insurer upon accepting the proposal form (offer) submitted by the policyholder. It not only certifies the lawful formation of the insurance contract, but also generally marks the official commencement of insurance liability (contingent upon premium payment).

Direct Document for Claims and Settlements:

When an insured vehicle is involved in a road accident or other covered risks, the key details stated in the policy (such as policy number, coverage types, limits of liability, etc.) serve as the sole primary basis for the insurance company to carry out on-site inspections, determine liability, and compute claim settlements.

Core Structure and Key Components of an Insurance Policy

A standard and compliant motor vehicle insurance policy typically comprises the policy schedule (original copy), main policy and add-on coverage clauses, and special provisions (endorsements), with its core content covering:

Particulars of Parties and Relevant Persons:

Sets out the name of the insurer (insurance company), alongside the names and valid identification details of the policyholder and the insured.

Accurate Profile of the Insured Vehicle:

Details the vehicle registration number, vehicle identification number (chassis number/VIN), engine number, make and model, seating capacity, load capacity, and initial registration date, ensuring the insured subject matter is uniquely and clearly identified.

Coverage Scope and Financial Limits:

Clearly specifies the primary coverage taken (such as comprehensive own damage insurance, third-party liability insurance) and various optional add-on covers.

Itemises the sum insured, limit of liability, absolute excess/deductible, applicable rates, and total premium payable for each coverage type.

Period of Insurance and Validity Period:

Clearly specifies the start and expiry dates down to the exact hour and minute (e.g. from 00:00 on 29 July 2026 to 24:00 on 28 July 2027), preventing any gap in coverage.

Evolution of Policy Formats and Compliance Requirements

With the integration of digital finance and InsurTech, the format and administration of insurance policies have undergone significant transformation:

Adoption and Legal Validity of E-Policies:

Electronic policies have now been comprehensively rolled out for both commercial motor insurance and mandatory motor liability coverage. Endorsed by relevant statutory regulations and industry guidelines, e-policies featuring secure digital signatures carry the same legal validity as conventional physical paper policies.

Vehicle owners can readily download, verify, or present their e-policies at any time via official insurer portals or centralised industry inquiry platforms, greatly streamlining vehicle inspections, road tax renewals, and insurance claims.

Legal Effect of Endorsements (Special Provisions):

Should policy details change during the period of insurance (such as vehicle ownership transfers, changes in vehicle use, or the addition of extra cover), the insurer will issue an endorsement. As an integral part of the insurance policy, an endorsement legally takes precedence over any conflicting terms in the original policy.
